This contract of agreement is made between you, the user of www.coolpooltas.com.au and Cool Pool Tas.

It is very important that you read through our Terms & Conditions, and the Disclaimer & Copyright carefully below. You must sign this agreement by checking the box ‘I accept this contract of agreement’, before becoming a member of www.coolpooltas.com.au and receiving access to our online carpooling resources.

Attention: YOU MUST BE AT LEAST 18 YEARS OF AGE TO ENTER INTO THIS AGREEMENT.

All rights and ownership of www.coolpooltas.com.au are the property of Cool Pool Tas (referred to in this contract as ‘We’, ‘Us, & ‘Our’). All contents and data included on our website, including but not limited to graphics, text and logos are the property of Cool Pool Tas or its suppliers/supporters and are protected by copyright laws. No content may be reproduced or used without having received prior written permission from us and any other copyright holder/s.

We provide this site solely to assist commuters in identifying potential carpool partners.

We do not assess the suitability of individuals participating in this carpool site, or their vehicles, and disclaim any liability in connection therewith.

You understand and agree that the use of our website and the service is entirely at your own risk.

The www.coolpootas.com.au website is provided at an "AS IS" OR "AS AVAILABLE" basis, without any warranties of ANY kind. To the fullest extent permitted by law we disclaim any warranties for:

1. other services or goods received through or advertised on our website or through the service, or accessed through any links on the website; and

2. viruses or other harmful components in connection with our website.

By agreeing to the terms of this agreement, you understand and agree that our services may be interrupted at any time, or cease operation altogether. We take no responsibility whatsoever for any failures, delays, or interruptions in the delivery of any content contained on our web site.

2. If you are registering for another person, you warrant that that person is aware of all their details that you are entering.

3. We reserve the right to reject your membership application and /or cancel your membership at our discretion, and without prior warning or notification. No membership fee is payable until your membership application has been accepted by www.coolpooltas.com.au.

1. In agreeing to the terms you are aware that WE

1. DO NOT cover you under any insurance policy and you are solely responsible for your insurance cover and safety.

2. DO NOT carry out checks on the persons who register at this site, or their vehicles, thus you must use your own discretion and caution.

3. DO NOT take responsibility for the content posted on this site, but reserve the right to edit, delete, and/or change it with out notification or explanation.

4. DO NOT agree to supply this site forever, and may at any time for any reason decide to limit, deny, modify or discontinue this site.

5. ARE NOT a transportation service. We are a resource for passengers and drivers in Tasmania to utilise at their own risk. By agreeing to the terms of this agreement you agree that we are not responsible for your travel arrangements and their outcomes.

You agree that we are free to use any comments, statements, information, ideas, concepts, reviews, hints, or techniques contained in communications you send to us, without further compensation, acknowledgement, or payment to you, for any purpose whatsoever. Furthermore, by posting information on our site, you grant us a nonexclusive, royalty-free license to display, use, reproduce, or modify that information.

2. Our service:

1. A website that enables drivers and passengers to find travelling companions. Drivers can offer lifts and passengers can find drivers that are prepared to offer lifts.

2. A forum centre where frequent commuters travelling the same route and festival and event commuters can discuss carpooling together.

3. We encourage our users to communicate with us so that we can provide better services and so that our users and the public at large may be informed about our services.

1. Personal Account

1. We provide you with your own user account. By agreeing to the terms of this agreement, you agree that the Administrator can remove your account and cancel your membership, at our discretion, and at any time, without explanation.

1. Privacy

1. By agreeing to the terms of this agreement, you agree to display your name and contact information, a personal description about yourself and photograph/s (if you choose this upload).

2. We will do everything that we can to ensure that your details are secured in our database. However, we take no responsibility should your personal information be retrieved in any way or form by another party or person.

3. By participating in our forums, online chat and/or posting feedback on rides you agree that we may display, delete, and/or change this information without warning or notification at any time.

3. Your obligations:

1. You represent and warrant that all information you supply to us is complete and accurate.

2. You agree to update your personal information if it changes.

3. You are solely responsible for maintaining the confidentiality of your account information, including your password, and for restricting access to your computer. You accept responsibility for all activities that occur under your account or password.

4. You agree not to use a false email address or otherwise mislead us or other users regarding the origin of any content you contribute to the site.

5. You may not assign or transfer your personal account to anyone.

1. Use of the site

1. You agree not to use this website for the purpose of making a profit.

2. You agree not to promote, market, solicit orders for, offer to buy or sell, goods or services via our website without prior written permission.

3. You agree not to transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software, hardware, equipment, or site content associated with our web site.

4. You agree that you might encounter illegal, obscene, threatening, vulgar, defamatory or otherwise objectionable material on our web site, for which we will not be liable. You should report such material so that we may take steps to remove it, although we are not obliged to do so.

5. You agree not to conduct yourself in an offensive manner while using our service and/or our web site, impersonate any other person while using our website, or use our website for any unlawful purpose.

6. You agree not to post statements that are illegal, obscene, threatening, vulgar, defamatory, or otherwise objectionable to us or other users.

7. You agree not to stalk or harass other users.

4. Communications:

   1. Complaints and feedback should be sent via our online link to feedback@coolpooltas.com.au

   2. You agree to update your personal information as necessary by amending the details on your personal sign-in page

   3. You can terminate your own account at any time by contacting us at accounts@coolpooltas.com.au.

   4. Information pertaining to Cool Pool Tas may be sent by the administrator of our web site to your email address at any time, without your permission.

   5. Members can contact us for any queries or concerns via email at admin@coolpooltas.com.au. We will answer questions in our own time at our own discretion. 

5. Funding/Sponsorship:

   1. Membership fees

      **     No membership fees are currently required (PROMOTION), such that if you register now, you will not (even in the future when we introduce the fee for NEW users) be required to pay the membership fee.

1. A 6 month membership fee of 8 dollars, or a life time membership (refers to 15 years) of 15 dollars must be paid before any membership request can be processed, accept where any special promotions are given by Cool Pool Tas. Membership can be extended and an email will be sent out warning of the renewal date. We take no responsibility if you fail to receive this email and your account is automatically terminated.

2. Payment of short term or life term membership fees entitles you to access and use of www.coolpooltas.com.au, as outlined in the terms and conditions. You are aware still that we may terminate your account at our discretion, and at any time.

3. Payment of membership fees DOES NOT give you ownership to any part or whole of this web site and service.

4. The membership fee is totally and completely non-refundable. If your account is not activated, terminated or the service is unavailable, we take NO responsibility whatsoever for your financial commitment to join Cool Pool Tas.
